Several state and federal laws address stormwater requirements. The most commonly known law is the federal Clean Water Act. The State of Illinois administers the stormwater program via the Illinois EPA.

Clean Water Act :
The Clean Water Act prohibits the discharge of any pollutant to waters of the United States from a point source unless the discharge is authorized by a National Pollutant Discharge Elimination System (NPDES) Permit.

The Clean Water Act includes the Storm Water Phase II Rule, which requires small municipal separate storm sewer systems (MS4s) to obtain an NPDES stormwater discharge permit from the Illinois EPA. Coverage under such a permit allows an MS4 to discharge stormwater to surface water. The permit is required because an MS4 is considered a point source of pollution.
